FlexApp Catalog — End User License Agreement

1. Acceptance of Terms
By clicking “I Agree” and accessing or downloading any software through the Liquidware FlexApp Catalog (“Catalog”), you (“End User”) agree to be bound by this End User License Agreement (“EULA”). If you do not agree to these terms, do not access or use the Catalog.
2. Nature of the Catalog
The Liquidware FlexApp Catalog provides pre-packaged third-party software applications (“FlexApps”) repackaged by Liquidware for use with the Liquidware FlexApp application virtualization platform. Liquidware does not own or hold intellectual property rights over the underlying third-party software.
3. Third-Party Software License Terms
Each FlexApp contains software owned by independent third-party vendors. By downloading any FlexApp, you acknowledge and agree that:
- You are subject to the original EULA(s) of each third-party software vendor whose software is contained in the FlexApp you download.
- Liquidware’s repackaging does not transfer, modify, supersede, or waive any rights or obligations under the original third-party license.
- It is your sole responsibility to review and comply with each applicable third-party EULA prior to downloading and deploying any FlexApp.
- By downloading a FlexApp, you represent and warrant that you hold the right to use the underlying software under its original license terms, including any required commercial licenses or entitlements.
4. Liquidware’s Limited Role
Liquidware’s involvement is strictly limited to technical repackaging. Liquidware makes no representations or warranties regarding the fitness, accuracy, completeness, or security of any third-party software in the Catalog, does not provide application-level support for underlying applications, and reserves the right to add, remove, or modify any FlexApp at any time without notice.
5. Permitted Use
FlexApps may only be used in conjunction with a valid licensed Liquidware FlexApp installation, in accordance with your organization’s software license entitlements, and for internal business purposes only. Redistribution is strictly prohibited.
6. Disclaimer of Warranties
THE CATALOG AND ALL FLEXAPPS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIQUIDWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE CATALOG OR ANY FLEXAPP.
8. Governing Law
This EULA is governed by the laws of the State of Georgia, United States. Any disputes shall be resolved by binding arbitration in Gwinnett County, Georgia.
